Divorce Lawyers Charleston SC | Don’t Represent Yourself in Family Court

January 4, 2019 By Patricia O. DeTreville Leave a Comment

divorce lawyers charleston sc

In my opinion, Family Law represents the best efforts of the legislature and the courts to do the right thing for people who may have temporarily lost their ability to find their way without substantial help. In other words, Family Law is an outline of what needs to be done, and how to do it, for people who may not be thinking clearly in the stress of separation and divorce. Legislatures make the laws, and judges interpret and enforce them.

This does not mean that every piece of Family Law, or every statute, necessarily applies to you or to your family’s situation. It is the job of divorce [Read more…]

Divorce Lawyers Charleston SC | What Happens at a Temporary Hearing?

November 14, 2018 By Patricia O. DeTreville Leave a Comment

divorce lawyers charleston sc

A Motion for Temporary Relief, commonly called a “Temporary Hearing,” is the first hearing in most cases filed in Family Court. The hearing itself is scheduled in response to a written motion filed by either side. The various clerk’s offices will schedule the date and time of the hearing. They are under a directive that this first hearing must be held within 30 days of filing the request; most often the hearing will come much sooner than the 30 day-deadline.

Why is a Temporary Hearing needed?

Judges take this opportunity to solve immediate, pressing problems, such as those that sim [Read more…]

Charleston Family Law Attorneys | Why Do Divorces Take So Long?

September 25, 2015 By Patricia O. DeTreville Leave a Comment

charleston family law attorneys

If you have ever been involved in a Family Court case, or if you have even heard about one, chances are good that you have heard complaints about how SLOW it is and HOW LONG everything takes. Even Charleston Family Law attorneys are known to complain. Why can the process be so slow? Please consider the following:

1) There are a limited number of judges for the Family Court.

Not only is there a shortage of judges, there doesn’t seem to be much interest in creating more seats. Our state legislature controls the funding for these positions, and the funding remains limited.

Charleston Divorce Lawyers | Holiday Survival Guide

February 25, 2015 By Patricia O. DeTreville Leave a Comment

charleston divorce lawyers holiday survival guide

It’s that time of year again. The holidays, of course, where children move back and forth between their separated or divorced parents, where money is short, where demands on time, temper and money become tight, and where small impressions made may live forever.

Suggestions to survive the holidays:

1) Follow the rules.

If you and your former spouse, or your separated spouse, have rules in place to govern the holidays, follow those rules. If you wanted to make changes, or ask for changes, or negotiate changes, this is not the time; that should have been done earlier, say in the summ [Read more…]

Adoptions continue to make news in South Carolina.

While you may not have heard of this particular case (being Jennifer Brown v. Baby Girl Harper, a minor under the age of seven, and Holly Lawrence, Appellate Case No. 2014-001746), Baby Girl Harper has recently past her first birthday. A few months ago, the South Carolina Supreme Court took on the enormous and sad responsibility of removing Baby Girl Harper from the home of her Adoptive Mother, Ms. Lawrence, and d [Read more…]

Charleston Family Law Attorneys | What Matters in Adoption Cases: #1, Notice to Necessary Persons

Within the past year, newspapers in the Charleston area were full of stories about a prolonged custody and adoption battle between an adoptive couple living in Charleston County and a biological father living in Oklahoma. While that case ultimately was decided by the US Supreme Court, and included issues of whether the child was a member of an Indian tribe, issues of notice were also argued. In any adoption case, the issue of notice to the people who are necessary to the cas [Read more…]

Charleston Family Law Attorney | Top 5 Ways to Solve Problems in Family Court

1) Hire an experienced Charleston family law attorney.

Beware of real estate lawyers (for example only) who are trying to make the rent by picking up a family law case here and there.

2) Hire a reasonable Charleston family law attorney.

If you want to have an expensive war with your spouse, feel free to hire that attorney who was pounding the desk when you first met, and/or telling you that he/she would “take your spouse to the cleaners” – such behavior, and such words, are warnings to you that you are [Read more…]

As a Charleston family lawyer, I often get asked many of the same questions by my clients, especially early on in my representation. Here are some of those questions, with the answers, that may help you start to sort through your family law matter in its early stages:

1. “When can I date?”

Perhaps not surprisingly, this is the most commonly asked question, week after week, year after year. Simply put, having a physical relationship [Read more…]
